Refunds Policy 1. Before an application for study at Academy is considered, the applicant is given the opportunity to read and understand the Policies and Procedures of the college. 2. When a Student applies to be enrolled at Academy they are making application for a place to be reserved for them for the purpose of training. 3. Academy of Learning evaluates an application and in approving that application and offering a place to the applicant, Academy undertakes to ensure that an Academic Place of Study is reserved and the training enrolled for is provided within the course dates agreed to. 4. When an applicant accepts the offer of an Academic Place of Study they are deemed to be fully aware of the terms and conditions of enrolment, college Policies and Procedures affecting Students and the policy effecting refunds. 5. The policy of the Academy with respect to refunds is based on the premise of offer and acceptance and once the application has been approved. Academy is committed to providing the training enrolled for. 6. Refunds are only made on the basis of a written withdrawal from the course within the first eight days of the course and in compliance with Section 236A of the Education Act 1989, the Fee Protection Policy and the Student Contract of Enrolment. 7. All course fees or deposits exceeding $500 paid in advance of a course are held in trust by the Public Trust, PO Box 31543, Lower Hutt for a period of eight days after the start of the course, after which the fees are drawn down on a pro rata basis over the length of the course. 8. Where written notice of withdrawal and request for a refund is received within eight days of the start of a course, then a full refund, less a cancellation fee of 10% of the monies paid, or $500 - whichever is the lesser - shall apply, except as in 9. and 10. below. 9. If a student withdraws or cancels a course after 8 days of the start of the course, there are no refunds payable. 10. Only in exceptional circumstances will withdrawals and refunds be considered after eight days of the start of the course, as in 7, 8, & 9 above. ‘Exceptional Circumstances’ shall mean where a student is dismissed or asked to leave by the Principal for reasons of poor or unruly behaviour, or for malicious damage to property, or when in the opinion of the Facilitator the student is unable to cope with the course content even after personal attention is given, or when in the opinion of the Facilitator, an incorrect career choice was made by the student. 11. Refunds under any other conditions and/or circumstances outside of the provisions in paragraph ten (10) above are entirely at the discretion of the Directors of Academy and there is no obligation upon the Directors, implied or implicit, in any of our policies or procedures that provide for a guaranteed refund on any other discretionary or extenuating basis. 12. Any application for refund, under paragraph six (6) must be made in writing to the Directors of Academy. 13. No application for refund will be considered where: a) a written application is not made b). the application is made outside of course dates 14. Any discretionary refunds agreed to by the Directors, is limited to a maximum of twenty percent (20%) of the pro-rata value of the course enrolment not elapsed. 15. Any refund of course fees under any condition shall be made to the person, persons or organisation originally debited with paying the fees.
